louisa hamer, (plaintiff), brought suit against franklin sidway, executor of estate of william e. story i, (defendant), sum of $5,000. on march 20, 1869, william e. story had promised nephew, william e. story ii, $5,000 if nephew abstain drinking alcohol, using tobacco, swearing, , playing cards or billiards money until nephew reached 21 years of age. story ii accepted promise of uncle , did refrain prohibited acts until turned agreed-upon age of 21. after celebrating 21st birthday on january 31, 1875, story ii wrote uncle , requested promised $5,000. uncle responded nephew in letter dated february 6, 1875 in told nephew fulfill promise. story stated prefer wait until nephew older before handing on (then) extremely large sum of money (according online inflation calculator, $5000 in 1890 worth approximately $130,000 in 2017). elder story declared in letter money owed nephew accrue interest while held on nephew s behalf. younger story consented uncle s wishes , agreed money remain uncle until story ii became older. william e. story died on january 29, 1887 without having transferred of money owed nephew. story ii had meanwhile transferred $5,000 financial interest wife; story ii s wife had later transferred financial interest louisa hamer on assignment. elder story s estate refused grant hamer money, believing there no binding contract due lack of consideration. result, hamer sued estate s executor, franklin sidway.
