as condition of sir john s marriage anne, sir anthony ashley required john cooper s heir use surname of ashley-cooper. furthermore, required if ashley-cooper male ever achieved nobility, title should carry name of ashley. in turn, marriage john, anne ashley transferred legal right of ownership of ashley estate @ wimborne st giles husband, john cooper. agreement made prior 1622, when john cooper, himself, created baron. john , anne s first son , heir born on 22 july 1621 @ grandfather s home @ wimborne st giles. accordingly, oldest son , heir of john cooper, christened anthony ashley-cooper @ birth. younger siblings remained coopers.


in later years, 4th earl of shaftesbury preserved note in family papers, stating sir anthony ashley-cooper unaware of marriage agreement established between father , grandfather, when chose title of baron ashley after restoration. happy when found out marriage , property agreement , amazed had unwittingly complied provision regardless of lack of prior knowledge.


six months later, on 20 july 1628, anne died of smallpox, leaving husband 3 children. 2 sons anthony ashley , george cooper. daughter, philippa, 2 years younger anthony, while george 2 years younger sister. george grew adulthood, relocated clarendon park , farley, wiltshire. philippa became wife of sir adam browne, 2nd baronet of betchworth. anthony inherited titles of grandfather, father, , father-in-law, st giles house , vast holdings of shaftesbury estate.
